abstract The so‐called ‘morning‐after pill’ is a drug that prevents pregnancy if taken no later than 72 hours after presumably fertile sexual intercourse. This article argues against a right of conscientious objection for pharmacists with regard to dispensing this drug. Some arguments that might be advanced in support of this right will be considered and rejected. Section 2 argues that from a philosophical point of view, the most relevant question is not whether the morning‐after pill prevents implantation nor is it (...) whether preventing implantation is tantamount to abortion. Section 3 suggests a more general philosophical question as most pertinent, namely whether and to what extent a pharmacist can justifiably be exempted from dispensing the morning‐after pill when to do so would entail participating in something that goes against his or her deepest moral or religious convictions. Section 4 explains why, within liberal institutions, pharmacists should not have the right to conscientious objection to dispensing the morning‐after pill. (shrink)

In the era of fake news, truth has become a different and more urgent political problem than the traditional issues of the arcana imperii and the lies of the rulers. Starting from this observation, and deepening some considerations contained in the essay by Hannah Arendt _Thruth and Politics_, the article offers a worried report on the possibility of truth (scientific and factual) not to be reduced to mere opinion among others, and concludes that only a loyal collaboration between epistemic authorities (...) and politics can make the judicial road for the protection of truth less attractive. Dino del Garbo, médecin actif dans les premières décennies du xiv e siècle, est surtout connu pour son commentaire au poème de Guido Cavalcanti Donna me prega. La présente étude propose l’édition d’une question quodlibétique sur la capacité de l’imagination à altérer le corps, disputée à Bologne ou Sienne dans les années 1320. Nous examinons le contexte médical et philosophique dans lequel s’inscrit cette question, en montrant notamment comment le débat s’est progressivement cristallisé autour de l’opposition entre un modèle (...) avicennien et un modèle aristotélicien des rapports entre l’âme et le corps. L’analyse de ce débat permet d’éclairer d’un jour nouveau la glose de Dino del Garbo à Donna me prega et aussi, de manière incidente, le poème lui-même. (shrink)

L'antigiudaismo cristiano è essenzialmente la credenza che il popolo ebraico debba rinunciare alla propria fede e convertirsi al cristianesimo. In questo testo viene studiata la prima forma sistematica di antigiudaismo sviluppata in termini filosofici e teologici da Agostino d'Ippona. Alla luce dell'analisi filosofica sembra che l'avversione di Agostino per la fede ebraica si fondi su un'autentica rimozione della specificità del popolo eletto, della Legge e della Rivelazione sul Sinai.

Pero en la carta a Garve de 1798 afirma que aquello que lo despertó del sueño dogmático fue la Antinomia de la razón pura. El propósito de este artículo es ofrecer una interpretación de estos dos testimonios autobiográficos, que permita conciliarlos de manera coherente. Voy a sostener al respecto que am- bos despertares aluden a un mismo proceso, que comienza con la advertencia de Hume sobre el (...) problema de la causalidad, y se consuma con el tránsito al examen crítico de la razón, propiciado por el problema antinómico. El artículo establece, principalmente, las consecuencias que el descubrimiento de la fotografía ocasionó en el sistema de las artes y en el ámbito de la reflexión teórica acerca de las manifestaciones artísticas. De este modo, el autor relaciona la expansión de la fotografía con la "muerte del arte", una expansión que patentizó la idea de la "muerte del arte" presente en la tradición romántica, desde Hegel hasta Schiller. Tomando como punto de partida el análisis que de este problema hace (...) class='Hi'>Dino Fonnaggio en su texto La muerte del arte y la estética, el autor reflexiona acerca del cuestionamiento que la fotografia hace del concepto de arte, de los límites del sistema de las artes y del establecimiento de las diferencias entre el artista, la obra y el espectador. Background The legitimacy of conscientious objection to abortion continues to fuel heated debate in Italy. In two recent decisions, the European Committee for Social Rights underlined that conscientious objection places safe, legal, and accessible care and services out of reach for most Italian women and that the measures that Italy has adopted to guarantee free access to abortion services are inadequate. Nevertheless, the Ministry of Health states that current Italian legislation, if appropriately applied, accommodates both the right to conscientious objection (...) and the right to voluntary abortion. Main body One empirical argument used to demonstrate that conscientious objection does not create barriers to abortion is the “no correlation” argument, which the Italian Committee for Bioethics employed to demonstrate that no association exists between conscientious objection and waiting times for voluntary abortion in Italy and to support the weak form of conventional comprise adopted by the Italian legislation to balance the conflict between women’ autonomy and healthcare professionals’ moral integrity. Conversely, we showed how the “no correlation” argument fails to demonstrate the absence of a relationship between the number of conscientious objectors and waiting times for voluntary abortion, and that the limitations of the “no correlation” argument itself demonstrate how it is still difficult to describe the real effect of conscientious objection on the access to abortion services and to evaluate the suitability of conventional compromise to effectively balance conflicting moral principles. Conclusion Further studies are needed to better describe the relationship between conscientious objection and waiting times for voluntary abortion. If new evidence would show that the increasing proportion of objectors does undermine the efficacy of the Italian law and the right of a woman to freely obtain a voluntary abortion, new ways will need to be found to address the conflict between moral principles and restrict the protection accorded to the principle of moral integrity. This would inevitably imply the need to constrain and to redefine the terms and conditions for claiming conscientious objection. (shrink)

In this paper, I give a metaphilosophical analysis of the core idea of deflationism by discussing some basic conceptual and methodological issues involved in the debate between deflationism and substantivism. In so doing, I argue for three positive points. First, the crux of the dispute between deflationism and substantivism is whether or not truth is substantive in its metaphysical nature and in its explanatory role in philosophical enterprises, rather than whether or not a minimal approach regarding conceptual resources is taken (...) to explain truth; a minimal approach itself is philosophically innocent. Second, there is no intrinsic connection between the core idea of deflationism and the Tarski-style equivalence thesis, which is often identified as implying or supporting the former. Third, there are some unbridged fundamental gaps between the core idea of deflationism and various redundancy theses; these redundancy theses cannot be identified as the former, nor can they be used to justify the former on their own. After a brief review of the notions of necessity and a priority, this paper scrutinizes Kripke's arguments for supposedly contingent a priori propositions and necessary a posteriori propositions involving proper names, and reaches a negative conclusion, i.e. there are no such propositions, or at least the propositions Kripke gives as examples are not such propositions. All of us, including Kripke himself, still have to face the old question raised by Hume, i.e. how can we justify the necessity and universality of (...) general statements on the basis of sensory or empirical evidence? Jin Yuelin 金嶽霖 was a Chinese philosopher and logician. From 1914 to 1920 he studied at the University of Pennsylvania and Columbia University, and received his Ph.D. in political science from Columbia in 1920. From 1921 until 1925, he studied in Europe and visited Great Britain, Germany, France, and Italy, among other countries. During these years, he studied at the London School of Economics and Political Sciences and at the University of Cambridge. At the end of 1925, Jin returned to (...) China and soon became a professor at Tsinghua University, where he began teaching logic in 1926. What is the value of fictions, metaphors, figures and scenarios in adjudication? This book develops three models to help answer that question: inquiry, artefacts and imagination. -/- Legal language, it is argued, contains artefacts – forms that signal their own artifice and call upon us to do things with them. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, la (...) extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

It is argued that the so‐called principles of “strong centering” and “weak centering” central to the traditional Lewis‐Stalnaker semantics for counterfactuals are both fallacious. A foundation for an alternative semantics without these prinsciples is outlined. The core idea is that the statistically normal worlds – rather than those worlds most qualitatively similar to the actual world – should serve as the semantical fulcrum.

This article systematically challenges Kripke's modal argument and Soames's defence of this argument by arguing that, just like descriptions, names can take narrow or wide scopes over modalities, and that there is a big difference between the wide scope reading and the narrow scope reading of a modal sentence with a name. Its final conclusions are that all of Kripke's and Soames's arguments are untenable due to some fallacies or mistakes; names are not “rigid designators”; if there were rigid designators, (...) description(s) could be rigidified to refer fixedly to objects; so names cannot be distinguished in this way from the corresponding descriptions. A descriptivist account of names is still correct; and there is no justification for Kripke's theory of rigid designation and its consequences. (shrink)

For years, experimental philosophers have attempted to discern whether laypeople find free will compatible with a scientifically deterministic understanding of the universe, yet no consensus has emerged. The present work provides one potential explanation for these discrepant findings: People are strongly motivated to preserve free will and moral responsibility, and thus do not have stable, logically rigorous notions of free will. Seven studies support this hypothesis by demonstrating that a variety of logically irrelevant (but motivationally relevant) features influence compatibilist judgments. (...) In Study 1, participants who were asked to consider the possibility that our universe is deterministic were more compatibilist than those not asked to consider this possibility, suggesting that determinism poses a threat to moral responsibility, which increases compatibilist responding (thus reducing the threat). In Study 2, participants who considered concrete instances of moral behavior found compatibilist free will more sufficient for moral responsibility than participants who were asked about moral responsibility more generally. In Study 3a, the order in which participants read free will and determinism descriptions influenced their compatibilist judgments—and only when the descriptions had moral significance: Participants were more likely to report that determinism was compatible with free will than that free will was compatible with determinism. In Study 3b, participants who read the free will description first (the more compatibilist group) were particularly likely to confess that their beliefs in free will and moral responsibility and their disbelief in determinism influenced their conclusion. In Study 4, participants reduced their compatibilist beliefs after reading a passage that argued that moral responsibility could be preserved even in the absence of free will. Participants also reported that immaterial souls were compatible with scientific determinism, most strongly among immaterial soul believers (Study 5), and evaluated information about the capacities of primates in a biased manner favoring the existence of human free will (Study 6). These results suggest that people do not have one intuition about whether free will is compatible with determinism. Instead, people report that free will is compatible with determinism when desiring to uphold moral responsibility. Recommendations for future work are discussed. (shrink)

Plagiarism detection services are a powerful tool to help encourage academic integrity. Adoption of these services has proven to be controversial due to ethical concerns about students’ rights. Central to these concerns is the fact that most such systems make permanent archives of student work to be re-used in plagiarism detection. This computerization and automation of plagiarism detection is changing the relationships of trust and responsibility between students, educators, educational institutions, and private corporations. Educators must respect student privacy rights when (...) implementing such systems. Student work is personal information, not the property of the educator or institution. The student has the right to be fully informed about how plagiarism detection works, and the fact that their work will be permanently archived as a result. Furthermore, plagiarism detection should not be used if the permanent archiving of a student’s work may expose him or her to future harm. (shrink)
